On Sunday afternoon, Fox News correspondent Bill Melugin reported Chacon-Gutierrez was a Venezuelan national who illegally entered the U.S. in November of 2023 near Eagle Pass, Texas, which was under siege at the time.

Chacon-Gutierrez crossed the Rio Grande among a group of around 600 illegal aliens, a Department of Homeland Security source told the New York Post.
“At the time, border agents were processing him for ‘expedited removal,’ but he argued he had a fear of persecution in Venezuela so he went before an asylum officer, who rejected his claim and continued to process him for removal,” the Post reports.
“Chacon-Gutierrez, however, asked to make his claim before an immigration judge, who quickly vacated his order of removal and let his case continue.”
Chacon-Gutierrez was given a notice to appear at a hearing in April of 2026 and released into the U.S. without any conditions, records reviewed by News 4 San Antonio indicate.
