Gorsuch emphasized the vital importance of an independent judiciary as court of last appeal
Supreme Court Justice Neil Gorsuch warned the Biden administration and Democrats to be careful over plans to reform the Supreme Court.
Gorsuch voiced his feelings on political changes to the Supreme Court in an interview on Fox News Sunday with Shannon Bream. The Supreme Court Justice, one of three Trump appointments, said that the Court serves as the last court of appeal for Americans and matters most of all when “the government’s coming after you.”
Gorsuch said he didn’t think it “would be helpful” to comment on specific proposals by the Biden administration, but instead chose to emphasis the vital role of an independent judiciary in American society.
“[An independent judiciary] means that when you’re unpopular, you can get a fair hearing,” he said.
“If you’re in the majority, you don’t need judges and juries to hear you, to protect your rights, if you’re popular. It’s there for the moment when the spotlight’s on you – when the government’s coming after you. And don’t you want a ferociously independent judge and jury of your peers to make those decisions?”

The Supreme Court, with its conservative majority, has been a target of Democrats for some time, especially since the decision to overturn Roe v. Wade and, more recently, the decision to uphold the notion of presidential immunity with regard to the 6 January case against former president Donald Trump.
Last Monday, the Biden administration announced a raft of measures targeted specifically at the Supreme Court, including term limits and an enforceable code of ethics. Introducing term limits would require a Constitutional amendment.
The Biden administration also wants to challenge presidential immunity.
“This decision today has continued the court’s attack in recent years on a wide range of long-established legal principles in our nation, from gutting voting rights and civil rights to taking away a woman’s right to choose, to today’s decision that undermines the rule of law of this nation,” Biden said in response to that decision, made at the beginning of last month.
Senate Majority Leader Chuck Schumer has also vowed to make Supreme Court reform a priority of the next Democrat administration if Kamala Harris wins in November.
“It’s a very big priority,” said Schumer this week in an interview with NBC.
“I feel very strongly for the sake of the republic we need reform in the courts.”
Schumer claimed Republicans have devised a “brilliant but destructive” way of getting the courts to pursue a “hard right” agenda without the support of voters.
“They spent three decades trying to take over the courts,” he said.
“They’ve achieved it.”
