Guatemalan ‘Migrant’ Charged in Fatal DWI Crash in Missouri

Suspect told police he fled scene of wreck because he was “afraid of being deported.”

A Guatemalan national has been charged after fleeing the scene of a fatal drunk driving wreck in Missouri because he was “afraid of being deported,” according to reports.

The deadly incident unfolded on the evening of August 10 in Branson.

Wilian Xetzain Garcia-Rodriguez, 31, lost control of the truck he was driving after striking a curb and other objects, authorities believe.

During an ensuing rollover crash, his passenger became trapped under the vehicle and was killed, according to the Branson Police Department (BPD).

Witnesses told authorities Garcia-Rodriguez broke the windshield and fled the scene on foot, but he was apprehended nearby a short time later.

Garcia-Rodriguez reportedly told officers he had consumed several beers before the crash and a blood alcohol test returned a reading of 0.272% — more than triple the legal limit of 0.08% in Missouri.

“Documents say Rodriguez said he had drunk 10-12 beers before blacking out, but remembered flipping the truck and told police he ran from the scene because he was afraid of being deported,” Ozarks First reports.

Garcia-Rodriguez was charged with DWI resulting in the death of another and resisting arrest.

A probable cause statement filed by BPD indicates Garcia-Rodriguez does not possess a valid driver’s license.

Additionally, it appears he was charged with a prior DWI in Pulaski County, Arkansas, but failed to appear in court.

BPD confirmed Garcia-Rodriguez is a citizen of Guatemala but his immigration status remains unclear.
