Justice Department Charges Whistleblower who Exposed Illegal Gender Surgeries at Texas Hospital

Haim’s charges all stem from alleged alleged HIPAA violations.

The Department of Justice (DOJ) has charged a whistleblower who exposed gender-related surgical mutilation happening at a Texas hospital.

Surgeon Dr. Eithan Haim was indicted on four felony charges over alleged violations of the Health Insurance Portability and Accountability Act (HIPAA). Last year, he had alerted several media outlets – including the City Journal magazine – that the transgender medicine program of Texas Children’s Hospital (TCH) in Houston included minor children among its patients. The ensuing controversy led the Texas Legislature to ban transgender medical procedures from being conducted on minors altogether.

While Haim’s brave actions exposed his employer’s dangerous and ethically dubious transgender medical practices, they have also drawn unwanted attention from an unlikely source. Federal attorneys in the Biden administration’s DOJ have now swooped in on the surgeon, launching legal action against him.

In June of last year, federal agents showed up outside of Haim’s home. The agents informed him at the time that he was being investigated as a suspect in the leaks regarding transgender medicine practice at TCH. It coincided on the same day Haim was to graduate from his hospital’s residency program.

Almost a year later, the DOJ decided to proceed with its prosecution of Haim, overseen by Assistant U.S. Attorney Tina Ansari still oversees. The surgeon recounted that U.S. marshals arrived outside his home with a court summons.

“Had three heavily-armed agents at my door … to inform me I was indicted with four felonies … for blowing the whistle about the largest children’s hospital in the world lying to the public about their transgender program,” Haim wrote on X.

“They wanted to intimidate me into silence using every technique the federal leviathan had at their disposal, but they failed. The only way to lose is to submit to corruption. It’s time to fight back harder than ever.”

According to the National Pulse, all four of the charges the DOJ filed against Haim stem from alleged HIPAA violations. The outlet added that he would appear in court on June 10.

Haim’s attorney Marcella Burke insists that her client went to great lengths to comply with HIPAA standards, even in his leaks to the media. The surgeon reportedly redacted any patient identifying information from the documents he provided to reporters. Even the City Journal‘s Christopher Rufo, who received documents from Haim, attested to this.

“I can confirm that nothing in the information provided to me identified any individual,” Rufo said. “All the documents were, in fact, carefully redacted.”

In contrast, the Dallas Express mentioned that Haim’s legal team were reportedly not given precise details from the DOJ about the felony charges. The outlet sent requests for comment to the Justice Department and Ansari’s office, but received no reply as of press time.

“My client is anxious to get to trial to get his side of the story told,” said Burke. “I am confident this will result in the correct decision being made.”

The Pulse ultimately pointed out that “the case appears to be less about HIPAA and more about silencing medical whistleblowers who would expose child sex-change practices at hospitals across the United States.”
