A new lawsuit from six red states brings the total of states suing the Dept. of Ed. to 15
A total of 15 states are now suing the Department of Education over recent changes to Title IX, which include controversial changes designed to protect LGBTQ+ students from sex discrimination.
Attorneys general from six red states—Kentucky, Tennessee, Indiana, Ohio, Virginia and West Virginia—filed a lawsuit on Tuesday. Three other lawsuits have already been filed, bringing a total of 15 states that are now suing the Department of Education over the Title IX changes.
The new lawsuit follows the previous three closely in terms of its claims. It states the Department of Education acted in a manner that was “arbitrary and capricious” by making the changes to Title IX and that it was acting beyond its constitutional powers.

In a press release to accompany the new filing, Kentucky Attorney General Russell Coleman slammed the changes to Title IX as a threat to girls’ safety.
“The Biden Administration’s new rule would rip away 50 years of Title IX’s protections for women and put entire generations of young girls at risk.”
Tennessee Attorney General Jonathan Skrmetti labelled the changes an “unconstitutional power grab.”
“The U.S. Department of Education has no authority to let boys into girls’ locker rooms,” he said.
“Under this radical and illegal attempt to rewrite the statute, if a man enters a woman’s locker room and a woman complains that makes her uncomfortable, the woman will be subject to investigation and penalties for violating the man’s civil rights.”
