Watch: Triggered Adam Schiff Scolds Special Counsel Hur for Report Criticizing Biden Age, Mental Fitness in Classified Docs Case

Democrat House Rep. defends Biden after Special Counsel report called puppet president “an elderly man with a poor memory.”

Rep. Adam Schiff (D-Calif.) took issue with Special Counsel Robert Hur during testimony Tuesday, criticizing the federal investigator’s characterization of Joe Biden in his report as an elderly man with memory problems.

“You could have chosen just a comment on the president’s particular recall, vis-à-vis a document or a set of documents, but you decided to go further and make a generalized statement about his memory, didn’t you?” Schiff pressed Hur during House Judiciary Committee testimony.

“Congressman, I could have written my report theoretically in a way that omitted references to the president’s memory, but that would have been an incomplete and improper report,” Hur responded.

Unsatisfied with his answer, Schiff continued to claim Hur intended to denigrate and politically damage Biden with his report, in which he described Biden as an “elderly man with a poor memory” with “significant limitations.”

“You could have written your report with comments about his specific recollection as to documents or a set of documents, but you chose a general pejorative reference to the president,” Schiff said. “You understood when you made that decision didn’t you, Mr. Hur, that you would ignite a political firestorm with that language didn’t you?”

Hur replied that politics “played no part whatsoever” in his investigation, however Schiff continued, “You cannot tell me you’re so naive as to to think your words would not have created a political firestorm.”

“You understood that didn’t you when you wrote those words when you decided to include those words?” Schiff asked.

Hur answered that he followed policy and submitted his report to Attorney General Merrick Garland, who he understood would have oversight over what parts of the report to release publicly.

“It was up to the Attorney General to determine what portions of the report would be released consistent with DOJ policy and legal requirements,” Hur told Schiff.

Schiff went on to claim Hur’s report was inconsistent with DOJ policy “that you are to take care not to prejudice the interests of the subject of an investigation,” and continued to insist Hur must have known the political damage his report would have caused Biden.

In his report into Biden’s retention of classified materials released in February, Hur wrote, “Mr. Biden’s memory also appeared to have significant limitations – both at the time he spoke to Zwonitzer in 2017, as evidenced by their recorded conversations, and today, as evidenced by his recorded interview with our office.”

He also wrote his conversations with Biden were “painfully slow” and that he was “struggling to remember events and straining at times to read and relay his own notebook entries.”

“In his interview with our office, Mr. Biden’s memory was worse,” Hur’s report stated. “He did not remember when he was vice president, forgetting on the first day of the interview when his term ended (‘if it was 2013 – when did I stop being Vice President?’), and forgetting on the second day of the interview when his term began (‘in 2009, am I still Vice President?‘).”

The special counsel also wrote he believed a jury would likely be too sympathetic to Biden because he’s “an elderly man with a poor memory.

“Based on our direct interactions with and observations of him [Biden], he is someone for whom many jurors will want to identify reasonable doubt. It would be difficult to convince a jury that they should convict him – by then a former president will into his eighties – of a serious felony that requires a mental state of willfulness,” Hur wrote.
